Certificate of age to add a home to the title deed and register it

A certificate of age (certificado de antigüedad) costs from €250 + VAT, between €250 and €600 depending on the floor area and the evidence available. The notary asks for it to declare a building in the deed on the grounds of its age (obra nueva por antigüedad): it certifies that the building was finished by a given date and that it matches the description in the title deed.

What the regulations say

Article 28.4 of the consolidated text of Spain's land act (texto refundido de la Ley de Suelo y Rehabilitación Urbana) allows old works without a licence to be registered once the enforcement measures to restore legality have become time-barred, with a certificate from a qualified professional confirming that they were completed on a specific date.

Questions about certificate of age

Does it work for any old house?

It works when the period for the town hall to act has passed and the house is not on land where the infringement never becomes time-barred. If that is not the case, the registrar will notify the town hall.

Is it the same as an AFO?

No. The certificate is for registering the building; the AFO (asimilado a fuera de ordenación) is a town hall decision that recognises its status. On rural land (suelo rústico) you often need both.
